Strict Penalties for Impaired Driving

  • A first conviction for DWI is punishable by fines up to $1,000, possible jail, six-month license suspension and other requirements and costs. Under Leandra's Law, all first offenders must install an ignition interlock device to get their driving privileges back.
  • A second DWI in New York is a Class E felony, carrying likely jail time, fines up to $5,000, license revocation for one year and ignition interlock.
  • A third DWI is a Class D felony, punishable by serious prison time, fines up to $10,000, lengthy revocation and other enhanced penalties.
  • Drunk driving penalties apply at .04 BAC for CDL drivers and .02 for under-21 drivers.
